Eligibility
HomeLife Realty Services Inc., is herein referred to as the (“Sponsor”). HomeLife’s Silver Anniversary $10,000 in Silver or $10,000 Cash Sweepstakes (the Contest”) is open to all legal residents of Canada, who have reached the age of majority in the province in which they reside on or before the Contest Closing Date. The Contest commences on or around February 1, 2010. To be eligible, all entries must be received by 11:59:59 P.M. EST (Eastern Standard Time) August 31, 2011 (the "Contest Closing Date"). Officers, directors, representatives and employees of the Sponsor, its parent, affiliates, or subsidiaries, their advertising, promotional, publicity, production or judging agencies, and all those living in the same household as the above individuals, are not eligible to enter. Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcohols, des courses des jeux (the Régie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purposes of helping parties reach a settlement.

Visit the Contest at www.homelife.ca, complete the online entry form by providing your name, address, email address, telephone number, and confirm compliance with the Contest rules and submit your entry online to be automatically entered in the Contest. In the event of a dispute regarding submission of an online entry, the entry will be deemed submitted by the authorized holder of the e-mail account. The authorized account holder is the individual who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address.
One Contest Entry per Envelope
All entries become the property of the Sponsor and shall not be returned. Entries generated by a script, macro or other automated means are void and the Sponsor reserves the right to remove any entries it believes to have be generated by a script, macro or other automated means. Entries that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with the Official Rules and Regulations, are also void. Proof of sending not deemed to be proof of receipt.
All submitted material will become the property of the Sponsor and none will be acknowledged or returned. The selected entrant(s) will be notified by mail, e-mail or telephone. Entries are subject to verification and will be declared invalid if they are altered or tampered with in any way.
Draw
On the fifth business day of each month during the sweepstakes period (starting March 5, 2010 and until September 7, 2011), an independent judging organization will randomly select ten percent (10%) of the entries received, during the previous month. Those randomly selected entries will then be eligible for a final random draw, on September 12, 2011 (the "Grand Prize Draw Date"), in Saint John, NB, at or around 8:30 a.m. EST. The odds of being selected in any given month to qualify for the Grand Prize draw are 1 in 10. The odds of being selected in the Grand Prize draw depend on the total number of entries received.
The judging will be conducted by an independent judging organization whose decisions on all aspects of this Contest shall be deemed as final and binding in all respects. By entering, participants agree to be bound by the Contest rules and regulations and the decisions of the independent judging organization. This Contest is subject to all applicable federal, provincial and municipal laws.
Prizes
Prize must be accepted as awarded. No substitution, transfers or refunds will be allowed. However, Sponsor reserves the right to substitute a prize of equal or greater value in Sponsor's sole discretion. Arrangements will be made for the prizes to be delivered to the confirmed winner’s place of residence.
Grand Prize
The single grand prizewinner may choose between $10,000 Canadian Funds in cash or $10,000 in Silver. Silver will be awarded in the form of bullion, bars or coins as determined by the Sponsor in its sole discretion.
In order to claim a prize and be declared a winner, the selected entrant will be required to:
Correctly answer, without assistance of any kind, the mathematical skill-testing question to be administered by mail or telephone at a pre-arranged mutually convenient time.
Complete and sign a declaration and release statement, in order to: confirm compliance with the rules and regulations, accept the prize as awarded, without substitution, release the Sponsor and its affiliated companies from any liability, as described more fully below, and consent to the use of his or her name, address (city and province), photograph, and likeness, as described more fully below.
Failure by any selected entrant to complete, sign and return any of the aforementioned documents within 14 business days after notification is sent to the address on the selected entrant's entry, or the return of prize documents as undeliverable, may result in forfeiture of the prize and selection of an alternate winner in the sole discretion of the Sponsor. If a selected entrant cannot be contacted in a timely fashion, or if for any other reason the prize cannot be awarded, including but not limited to the Sponsor’s belief that the selected entrant used a script, macro or other automated means to enter the Contest, another Contest entry will be randomly selected by draw until the prize has been awarded. Failure to correctly answer the skill-testing question will result in disqualification, the forfeiture of his or her interest in the prize, and the random selection of a substitute winner from among all remaining eligible entries. Communication will be entered into only with selected entrants.
Personal Information
The entrant consents to the Sponsors' collection, use and disclosure of his or her personal information to any third party for consumer research, an offer to provide real estate services, marketing and contest-administration purposes.
The entrant consents to receive product-related information from the Sponsor, for the purpose of notifying contest entrants of new products and obtaining customer feedback.
No Responsibility
The Sponsor assumes no responsibility for:
lost, delayed, destroyed, misidentified or misdirected entries, or entries deemed irregular by the contest Sponsor in its sole discretion, which are automatically void;
incorrect or inaccurate capture of entry information, technical malfunctions, human or technical errors, printing errors, lost, delayed or garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer line or network, computer equipment, software or any combination thereof, whether originating from sender or recipient; and
any problems, errors or negligence that may arise or occur in connection with the Contest including but not limited to any damage to an entrant's computer equipment, computer system, software or any combination thereof, any disclosure or publication of the entrant’s contact information as a result of the entrant's participation in this Contest.
The Grand Prize Options
The grand prize winner may choose $10,000 in Silver (the “Silver Option”). Silver will be awarded in the form of bullion, bars or coins as determined by the Sponsor in its sole discretion. The Sponsor makes no warranty with respect to the Silver Option and expressly disclaims all warranties express or implied with respect to the Silver Option, including but not limited to, any warranty of availability, quality, merchantability or fitness for a particular purpose of any prize offered. The Sponsor shall not be liable for any direct, compensatory, indirect, special, or punitive damages whether by action in contract, tort (including negligence), strict liability, warranty, statutory right or any other basis with regards to the Silver Option even if The Sponsor has been advised of the possibility of such damage or if such damage was foreseeable. The Sponsor reserves all rights including the right to modify any aspect of the Silver Option or cancel the Silver Option at any time. The Silver Option is available in any province where permitted by law but void where prohibited by law.
Or the grand prize winner may choose ten thousand dollars ($10,000) in Canadian Funds.
Right to Cancel
The Sponsor reserves the right to cancel or modify this Contest if, in its sole discretion, it determines that for any reason this Contest is not capable of running as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of this Contest. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole discretion, to cancel or suspend the Internet portion of this Contest should a virus, bug, computer or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of this Contest.
Criminal Prosecution
Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
General Release and Indemnity
By entering this Contest, entrants agree to release and indemnify and hold harmless the Sponsor and its parent and affiliates, subsidiaries, advertising and promotional agencies, and their respective directors, officers, employees, lawyers and agents, from any claim, loss, expense (including legal fees) or other liability which may be sustained in connection with the Contest, including, without limitation, any damages resulting from the receipt, ownership or use or misuse of the Grand Prize, or while preparing for, participating in, and/or traveling to any Grand Prize-related activity.
No Warranties
The Sponsor shall not be liable to the winner of any prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, including, without limitation, its quality, condition or fitness for a particular purpose.
Publicity Release
By entering this Contest, entrants consent to the use of their name, age, address, photograph, likeness in any publicity related to this Contest carried out by the Sponsor, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, unless prohibited by law.
Province of Quebec
Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
